When does an NRI marriage become a domestic violence case?

Many NRI cases look different from a local dispute, but the legal protection is the same.

Wife left in India

The husband lives abroad and the wife and children are in India, with no support, or are being pushed out of the matrimonial home.

Wife returned from abroad

A woman who faced abuse in another country comes back to India and needs protection, residence and maintenance.

In-laws named as respondents

Parents, sisters or brothers of an NRI husband are named in a complaint, sometimes with general allegations.

Dowry and money pressure

Demands for money, property or a sponsor’s promise, or confiscation of a wife’s passport and papers.

Can an Indian court act if the husband lives abroad?

Yes, in many cases. Under Section 27 of the Protection of Women from Domestic Violence Act, 2005, the Magistrate of the area where the woman lives (permanently or temporarily), where the respondent lives, or where the incident took place can hear the application.

If the woman is living in India, the court can pass protection, residence, custody and monetary orders even if the husband is overseas. Notice can be served as directed by the court, for example by email, courier or through the Indian mission, and the respondent can reply through an advocate on a power of attorney.

  • Orders can attach to the shared household and to assets in India.
  • Maintenance and monetary relief can be based on the husband’s income abroad.
  • Enforcement against a husband outside India may need extra steps, which we plan from the start.

If you are facing abuse abroad

Your safety comes before any legal step. These practical points apply wherever you are.

  • Call local emergency services in the country where you are, and move to a safe place such as a friend’s home, a shelter or a hotel if you can.
  • Keep your passport and documents or copies of them. Take photographs of injuries and save messages, call logs and bank records.
  • Contact the Indian Embassy or Consulate for emergency assistance. They can guide you on local support services.
  • Do not sign papers you do not understand, such as visa withdrawals, consent forms or settlement terms.
  • Speak to us in confidence. We explain what you can do in India and how it fits with any case or protective order abroad.

How we handle an NRI domestic violence matter

We plan around your time zone and your safety.

  1. Private consultation

A confidential call by phone, WhatsApp or video. We listen first, then explain your options in simple language.

  2. Evidence and affidavit

We help you organise records, build a timeline and prepare an affidavit, including documents from abroad.

  3. Filing in India

The application is filed before the Metropolitan Magistrate, with requests for urgent protection, residence and maintenance.

  4. Hearings and follow-up

We appear for you, ask for video appearance where possible and send written updates after each hearing.

If you are the NRI husband or a family member in India

If you are the respondent, do not ignore a notice from an Indian court. Reply within time, appoint an advocate and, if you cannot travel, give a power of attorney attested for use in India. We seek video appearance where possible and press for fair directions on maintenance and residence.

Family members in India, such as parents or siblings, should avoid contacting the complainant directly and should keep records that show where they actually live and what role they actually played. See also our page on a false domestic violence case.

Questions about NRI domestic violence cases

Can I file in India if the abuse happened abroad?

It depends on the facts. If you live in India now, or if part of the cause of action or the shared household is in India, the Indian court can often hear the case. We assess jurisdiction in your first consultation.

Can the court order my husband to pay maintenance if he lives abroad?

Yes. The court can order monetary relief based on his income and your needs, though collecting from abroad can take extra steps, which we plan from the start.

Do I have to travel to India for the hearings?

Not always. Your advocate appears for you and, where the court allows, you can join key hearings by video link.

Is a protective order from a foreign court recognised in India?

Not automatically. An Indian court looks at its own law. We advise how to use foreign orders as evidence and plan your Indian case alongside them.

Will the case affect my immigration status?

Immigration questions are separate, and you should speak to an immigration lawyer in the country concerned. We coordinate so that your Indian steps do not create problems.

My husband has filed a case abroad. What should I do?

Do not ignore it. Get local advice immediately, and speak to us about your options in India, including a petition for protection, maintenance or a divorce case.

I am an NRI husband and my wife filed in India. Do I have to come at once?

Not always. You must respond, but we can reply through a power of attorney and ask for video appearance, depending on the court.

Is my consultation confidential?

Yes. Everything you share stays private, and we can speak at a time and by a method that is safe for you.

Please note: This page gives general information and is not legal advice. Every case depends on its own facts, so please consult an advocate before acting.
